1. Acceptance of Terms

Welcome to RentalArt. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Digital Intelligence Office For Research and Development("RentalArt," "we," "us," or "our"), governing your use of the RentalArt platform and services.

By creating an account, accessing, or using RentalArt, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

3.1 Software Features

RentalArt provides a cloud-based rental property management software that includes:

• Property Management: Track buildings, units, and rental properties
• Contract Management: Store and manage rental contracts (digital and PDF)
• Tenant Management: Organize tenant information and communication
• Payment Tracking: Monitor payment schedules and status
• AI Extraction: Automated contract data extraction from PDF documents
• Bulk Upload: Upload multiple contracts simultaneously
• Reporting: Generate financial and occupancy reports
• Multi-Language: Arabic and English interface support

3.2 Service Availability

• Services are provided on an "as is" and "as available" basis
• We strive for 99.9% uptime but do not guarantee uninterrupted access
• Scheduled maintenance will be announced 24 hours in advance when possible
• Emergency maintenance may occur without notice

4. Eligibility

4.1 Age Requirement

You must be at least 18 years old to use RentalArt. By using our services, you represent and warrant that you meet this age requirement.

4.2 Authority

If you are using RentalArt on behalf of an organization:

• You represent that you have authority to bind that organization to these Terms
• References to "you" include both you individually and the organization
• The organization is responsible for all actions taken through its account

5. Account Registration and Security

5.1 Account Creation

To use RentalArt, you must:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Create a secure password
• Verify your email address
• Accept our Privacy Policy and Cookie Policy

5.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Logging out from shared or public devices

5.3 Account Suspension

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You provide false information
• Your account is used for illegal activities
• You engage in abusive behavior toward our staff or other users
• Payment for subscription services fails

6. Acceptable Use Policy

6.1 Permitted Uses

You may use RentalArt for:

• Managing your rental properties and contracts
• Storing and organizing tenant information
• Tracking rental payments and schedules
• Generating reports for your business
• Any lawful business purpose related to property management

6.2 Prohibited Uses

You may NOT use RentalArt to:

• ❌ Upload malicious code, viruses, or malware
• ❌ Attempt to gain unauthorized access to our systems
• ❌ Scrape, crawl, or harvest data without permission
• ❌ Reverse engineer or decompile our software
• ❌ Resell or redistribute our services without authorization
• ❌ Upload illegal, infringing, or harmful content
• ❌ Impersonate others or misrepresent affiliations
• ❌ Use automated systems to create multiple accounts
• ❌ Spam, harass, or abuse other users or our support team
• ❌ Violate any applicable laws or regulations

6.3 Consequences of Violation

Violation of this Acceptable Use Policy may result in:

• Immediate account suspension or termination
• Removal of prohibited content
• Legal action and reporting to authorities
• No refund of subscription fees

7. Intellectual Property Rights

7.1 Our Intellectual Property

RentalArt and all associated content, features, and functionality (including but not limited to software, design, text, graphics, logos, and trademarks) are owned by us and protected by international copyright, trademark, and other intellectual property laws.

7.2 Your Content

Content you upload to RentalArt (contracts, tenant data, PDFs, etc.) remains your property. However, you grant us a limited license to:

• Store and process your content to provide services
• Make backups of your content for disaster recovery
• Display your content back to you in the application
• Process PDFs through AI for extraction (with your explicit action)

Important: We do NOT use your content to train AI models, sell to third parties, or use for any purpose other than providing you with services.

7.3 Content Responsibility

You represent and warrant that:

• You own or have rights to all content you upload
• Your content does not infringe any third-party rights
• Your content complies with all applicable laws
• You are solely responsible for the accuracy of your data

8. Payment and Billing

8.1 Free Tier

RentalArt offers a free tier with limited features and storage. Free accounts may be subject to:

• Storage limitations
• Feature restrictions
• Automatic pausing after extended inactivity

8.2 Paid Subscriptions

If you upgrade to a paid plan:

• Fees are billed monthly or annually in advance
• Payment is due on the date you subscribe and each renewal date
• Prices are subject to change with 30 days' notice
• Failed payments may result in service suspension

8.3 Refunds

All digital sales are final. RentalArt is delivered immediately on payment, and subscription fees are not refundable. Cancelling stops the next renewal; it does not refund the period already running. Use the free trial, which requires no card, to decide before you pay.

This does not cover money taken in error. We will always return a charge that was taken twice, taken after cancellation, taken at the wrong amount, or taken from an account that is not yours — and anything the law requires us to return, whatever these Terms say. See the Refund Policy.

8.4 Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• You retain access to paid features until the end of the billing period
• No refunds for partial months

9. Data and Privacy

Your use of RentalArt is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. Key points:

• RentalART uses HTTPS/TLS for data in transit
• Use the data-request form to submit an access, correction, or deletion request

10.1 Service Disclaimer

RentalArt is a property management tool only. We do not provide:

• ❌ Financial advice (consult an accountant for tax/financial matters)
• ❌ Tenant screening or background checks
• ❌ Property valuation or appraisal services
• ❌ Compliance certification for local rental laws

10.3 AI Extraction Disclaimer

Our AI-powered contract extraction feature:

• May not be 100% accurate
• Requires your review and verification
• Should not be relied upon without manual confirmation
• Is provided as a convenience feature only

You are responsible for verifying all extracted data before relying on it.

10.4 Third-Party Services

RentalArt uses third-party infrastructure (Cloudflare, Neon, Google Cloud). We are not responsible for:

• Third-party service outages or failures
• Changes to third-party terms or pricing
• Third-party data breaches (subject to our data protection measures)

11. Limitation of Liability

11.1 Maximum Liability

Our total liability to you for any claims arising from these Terms or your use of RentalArt shall not exceed the amount you actually paid us in the 12 months preceding the claim.

11.2 Exceptions

These limitations do not apply to:

• Our gross negligence or willful misconduct
• Fraud or fraudulent misrepresentation
• Liability that cannot be limited by Saudi Arabian law

12. Indemnification

You agree to indemnify, defend, and hold harmless RentalArt, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your violation of any rights of a third party
• Your misuse of the service
• Content you upload or share through RentalArt
• Your breach of any representation or warranty

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict of law principles.

13.2 Jurisdiction

Any disputes arising from these Terms or your use of RentalArt shall be subject to the exclusive jurisdiction of the courts of Alkhobar, Saudi Arabia.

13.3 Informal Resolution

Before filing any legal claim, you agree to first contact us at support@rentalart.sa to attempt to resolve the dispute informally. We'll work with you in good faith to reach a resolution within 30 days.

13.4 Arbitration (Optional)

For disputes that cannot be resolved informally, both parties may agree to binding arbitration in accordance with the Saudi Center for Commercial Arbitration (SCCA) rules.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do:

• We'll update the "Last Updated" date at the top
• We'll notify you via email for material changes
• We'll display a notice in the app for 30 days
• Changes take effect immediately upon posting

Your continued use of RentalArt after changes constitutes acceptance of the new Terms. If you do not agree with the changes, you must stop using the service and cancel your account.

15. Termination

15.1 By You

You may terminate your account at any time by:

• Going to Settings → Account → Delete Account
• Emailing us at support@rentalart.sa

Upon termination, your data will be deleted within 30 days (see our Privacy Policy for details).

15.2 By Us

We may suspend or terminate your account if:

• You violate these Terms or our policies
• Your account is used for illegal activities
• You fail to pay subscription fees
• We are required to do so by law
• We cease operations (with 60 days' notice)

15.3 Effect of Termination

Upon termination:

• Your access to RentalArt will cease immediately
• You may export your data within 30 days
• Your data will be deleted after 30 days
• No refunds for prepaid subscription fees (unless legally required)
• Sections of these Terms that should survive (liability, indemnification) remain in effect

16. Miscellaneous Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and RentalArt regarding your use of the service.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.

16.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, or strikes.
